1. Artwork Rights
The artist retains full copyright to all of my artwork.
The artist only retains copyright of the artwork, while the copyright of the characters involved is retained by their respective owners.
The artist's artwork may not be copied, reproduced, traced, edited, referenced, used or reuploaded in any way without written permission.
The artist retains commercial rights to all of their artwork.
All their art may be used in advertising and/or potential digital collections (with due credit to the characters' owners), but no physical merch will be created using art that involves clients' original characters without their explicit written consent.
The artist's artwork may not be used for commercial purposes/reselling/advertising/branding/making any profit without explicit written permission.
Artwork ordered specifically for commercial purposes will be subject to a one-time license fee or royalty payment, depending on the project and use intended for it.
The exact contract will be discussed with the individual client.
Commercial use licenses are non-transferable and exclusive to the original client, and proper credit will still be required.
The artist retains full display rights.
At their discretion, all artwork may be posted to any and all galleries, used in personal promotional material, and potentially have its process livestreamed/recorded/shared publicly, unless previously agreed otherwise.
The artist's art cannot be reposted without permission and direct credit/my watermark/signature.
Fanart may be reposted, but the image must not be cropped/edited/ without the artist's signature, and must be with direct and clear credit.
When crediting with permission, you may link to the artist's active social media, website, or credit under the name WhitewingsArt.
All and any artwork ever created by the artist, be it personal, free or commissioned, are not to be associated in any way with non fungible tokens, cryptocurrency or anything blockchain-based, nor to be used in/to train "Artificial Intelligence" image generators of any kind.
This sort of use of my work is strictly prohibited and will lead to the immediate and permanent blacklisting of all parties involved, regardless of its intent. Please report any of these activities to me promptly.
The artist reserves the right to refuse a commission at any time, for any reason, without obligation of justification.
The artist reserves the right to change any and all information on this page at any time without warning. Only previous written agreements won't be voided unless specifically addressed.
Owners of the characters have the same rights and obligations as clients themselves, regardless of how they received the art made by me.
Clients and owners of the characters are allowed to repost their paid-for artwork and use it in any personal way they desire, as long as they don’t claim it as their own, meaning that the artist's watermark/signature is visible and/or they're directly credited.
Clients have the right to edit their artwork by cropping and resizing for personal use.
Any other edits are prohibited without explicit permission, so if want to heavily modify the art (i.e. color lines, recolor, add to it, etc), please contact the artist first for approval.
Edits done through image generators or anything tied to machine learning will lead to the immediate and permanent blacklisting of all parties involved.
Clients are allowed to use their paid-for artwork for personal/non-profit use only, which include limited runs of free merch (i. e. prints, stickers, personal/group shirt, etc).
Mass production of free merch and/or use in commercially-relevant settings or branding may not be done without my explicit permission.
Artwork made by the artist can be included with due credit in the resale/trade/gift/passage of ownership of the character they were drawn for, and the new owner will inherit the same rights to the artwork in question with the respective obligations.
The artist's public artwork always has their signature and/or my watermark. Clean full-quality versions of the artwork provided to clients are for personal use only and are not to be posted anywhere.
When commissioning the artist, the client is paying for a service that results in digital goods, not the digital goods themselves.
The expertise and time already applied to the commission process are non-refundable, meaning that completed commissions are not eligible for refunds.
In the event of a full refund, the clients lose all rights to the artwork they initially paid for.
In the event of chargeback fraud, the clients involved will lose all rights to the artwork and be blacklisted, unless the situation is promptly addressed and compensated for.
Work files are not provided unless explicitly asked for by the client, and they are not guaranteed to be delivered at all or exist past a year since completion.
2. Behavior and Respect
Clients must be 18 years old or older to order a commission. Parent permission is not accepted.
Repeated infringement of my ToS and serious violations will automatically cancel the client's order and a refund will be issued. If deemed necessary, The client will be blacklisted.
Rudeness, harassment, violation of boundaries, stalking and any illegal behavior towards the artist or any other party involved in their business will result in direct blacklisting with no appeal. History of scamming and aforementioned behavior will have the same result.
The artist does not haggle. Discounts/offers are decided solely by them.
Please check the public queue before asking for updates.
Not all time dedicated to art is part of work days, meaning that personal art and projects will be worked on in-between paid work.
Clients are expected to respect this, as it is necessary to avoid burnout and the artist will do their best to remain on schedule regardless.
A commission transaction does not grant you further social interactions, and you'll be expected to respect boundaries.
The artist is only responsible for their own mistakes, meaning that they are not liable for mistakes on the client's part.
The artist does not take responsibility in the event of improper use of someone else's character, be it stolen or used without permission.
In case of suspicion, proof of ownership of a character or written permission for the use of someone else's character will be required.
The artist does not work with people who use AI-generated images or anything related to web3, nor wishes to be associated with them. This includes references and examples, which will void the order immediately.
3. Commission Process
This is the recap version of the Commission Guide page, which is to be considered an expansion of this section of my Terms of Service.
I do NOT: offer rush orders, work with strict deadlines, reserve slots, do surprise commissions.
My work hours are available in my Schedule.
Some hours will be dedicated to communication or other art, but it also might not be always accurate due to external causes.
All communication regarding commission work is to be done through email, unless stated otherwise.
Work emails are checked and responded to only within work hours, usually within a couple of business days.
Commission requests usually go through a selection and are not "first-come, first-serve".
Selected clients will be contacted privately to confirm the quoted price and ask/address any additional questions.
Failing to respond or pay within the indicated time frame after being selected for a commission will result in the order being voided.
Auction winners will additionally get blacklisted.
Clients will receive WIPs of their commission regularly, depending on the amount of progress or necessity of feedback.
Clients are encouraged to give honest feedback at each stage, as it's their responsibility to notify me of the needed adjustments at the corresponding stage.
Once the commission has passed the respective stages, revision requests will be considered case-by-case and may be subjected to fees.
In the event of no client response to WIP updates, a reminder will be sent after 72 hours, and the commission will be put on pause.
Without any response for over a week, at my discretion I may continue working on it without feedback to clear my queue or offer a refund.
Clients who are unable to give feedback within that timeframe can ask to extend the pause up to 3 weeks max, after which a refund will be offered.
Giving artistic freedom means that the client will get their commission done faster, but it also means full trust in the artist's skills and that major revisions won’t be possible once the artwork is completed.
Edits required by the artist's own mistakes will always be free of charge.
Generally, revisions won’t be allowed on completed and approved pieces, but paid edits are up for discussion within the year since completion.
Turnaround time is usually much quicker, but please allow at least 4-8 weeks from the day of invoice payment for it to be completed.
The artist retains the right to reuse any rejected draft at their discretion.
4. Payment
Payment is in € (EURO) and through Paypal invoices, unless agreed otherwise.
Payment must be sent within 48 hours or the agreed time frame, otherwise the order will be voided. Failing to pay within the agreed time frame will result in the order being voided.
Payment is in full upfront, unless a payment plan is agreed to. Work on the commission won't be started until the agreed payment is received.
For tracking and safety reasons, the artist will be sending the invoice on Paypal.
In the rare case something needs to be shipped, shipping costs will be discussed with the client and calculated into the price. Eventual customs are on the client.
Tips are not necessary, but always appreciated!
5. Refunds
Full refund
If I (artist) decide to cancel a paid order (for any reasons) or I have not started your commission before your request of refund, you will get a 100% refund.
Clients lose all rights to the artwork they initially paid for. The artist retains the right to reuse the cancelled commissions as they please.
Partial refund
If you (client) decide to cancel a paid order that has already been worked on, you will get a partial refund (depending on the progress made) and receive privately what has been worked on up to that point.
Clients retain their rights and obligations to the received artwork.
Refund refusal
No refund will be provided once the order has been finished.
Do NOT take your money back on Paypal without asking the artist for a refund first, as both accounts could run into issues with Paypal.
If the artist handles the refund, money will be returned faster and without losing PayPal’s fees. In the event of chargebacks issued by the client or their bank service, the related fees must be compensated by the client.
Please don't commission anyone if there is a known chance you'd need the money. I won't withold money if things suddenly go wrong, but I (or anyone else) may be in a similar position after a cancelled order.

A. General
• 1. Commission basics
â—‹ Commission slots and Your Character Here (YCH) are advertised on my active sites when available.
â—‹ Slot amount, available commission types and specific details/rules may change every time.
â—‹ I rarely open for many slots at once, and they are not "first come, first serve" unless stated otherwise.
â—‹ You can always send me a commission inquiry via email to get a quote and/or check ahead of time if I will accept your idea.
â—‹ Clients are encouraged to give feedback promptly, as it's their responsibility to notify me of needed adjustments at the correct stage to avoid extra fees.
â—‹ By commissioning me, you automatically agree to my Terms of Service, so make sure to read them first.
• 2. Work hours
â—‹ My work hours are kept updated in my Schedule, but they may not always be accurate due to external causes.
â—‹ Not all work hours are dedicated to commission work: communication happens only during work hours and other art may be worked on in-between.
â—‹ Any major disruption to my schedule will be promptly notified to current clients, marked in the dedicated page and mentioned in my socials if necessary.
• 3. Deadlines & Rush orders, Slot reservation, Surprise commissions
â—‹ As a general rule, I do NOT accept nor offer any of the above.â—‹ If there's a deadline you'd like me to meet, please make sure to commission me within a reasonable time frame and mention it when applying.
I will try to prioritize the commission in my queue when possible, but I will not rush it.
â—‹ Likewise, any estimated deadline I may give is entirely indicative.â—‹ The one exception to the "no reservation" rule is that, if enough time has passed since the opening of unsold slots, trusted returning clients may ask me to hold a slot for them for a short time. This is strictly on a case-by-case basis.â—‹ Depending on the theme, commissions involving someone else's characters may require written permission from the owner (directly or through the client).
â—‹ As such, I do not do "surprise" commissions anymore, but I can do partial surprises by obscuring details in my queue and delay public showcase.
B. Communication
â—‹ All communication regarding commission work is to be done through email, unless stated or agreed otherwise.
â—‹ Social media private messages are used only to address inquiries, redirect further business communication to email, or to send reminders to check emails.
â—‹ If you want to ask me something on social media, please skip the small talk and get to the point right away ("Hi" and similar empty messages may be ignored).â—‹ Work emails are checked and responded to only during work hours, with replies being usually sent out within a couple of business days at most.
â—‹ Please check my Public Queue before asking for updates. It's updated regularly and will mark any required or current action on either part.â—‹ Correspondence must be held in English or Italian.
â—‹ I prefer a casual tone and like the use of emotes/emojis, but I will always try to match the client's tone.
C. Commission Process
• 1. Commission details
Clients need to provide the following information:1. Username and social media contacts
This is needed to identify you in my queue, to tag/credit you when posting the finished commission, and as a backup contact (ie. for reminders to check your emails).
You can request to remain anonymous in the queue/when posting, for any reason.2. Your email(s)
Please specify whether your PayPal email is the same as the one you're writing from. Mine will not be.3. Type of commission
I will need to know what type and tier of commission you want in order to give you a proper quote.
Keep in mind that the prices indicated on my Price List are just a baseline and will change depending on the complexity of the subject.4. Info about the character(s)

Name, species, gender, overall personality, etc.> Visual references
â—‹ Flat-colored reference sheets are preferred, but any artwork with flat/discernable colors is okay.
â—‹ Artwork with intense rendering, game screenshots and 3D models are permitted, but unless colors are left up to the artist's interpretation, they should be supplemented with a palette/hex codes/clear indications during feedback.
â—‹ Clarify missing details if they're relevant to the commission (skin/tongue color, body type, gender presentation, accessories, etc).
â—‹ Let me know if changes have been made to the character's design that are not portrayed in the provided references.
â—‹ I color-pick, but I reserve the right to make small color adjustments when it's needed for the artwork. Rendering will always impact the final colors.
○ I do not work with written references alone, unless the character has a very simple design, it’s a reference sheet commission or I get artistic freedom for the design.
â—‹ IMPORTANT: I do not work with AI-generated images and will reject clients who knowingly use them. Not sorry.> Any and all relevant info about the character(s)
A bit of relevant info on the character's personality and lore can go a long way in characterizing your character correctly!5. Description of your idea
â—‹ If you have a specific idea in mind, punctuated lists, doodles and references for poses/body type/backgrounds/etc are highly encouraged to more easily get the idea across.
â—‹ If you don't know what you want exactly, you can give me just a few keywords or artistic freedom.
â—‹ Depending on the theme, commission involving someone else's characters may require written permission from the owner (directly or through the client).
â—‹ If you want your commission to be a partial surprise, let me know and I will obscure details on my queue, won't post WIPs of it and delay public showcase.
• 2. Placing an order
â—‹ The way to claim slots will be indicated during each commission opening. It may be a form, email, direct messaging, etc.
â—‹ Commission requests usually go through a selection process of sorts to make sure I'm the right fit for your idea, and as such are generally not "first come, first serve".â—‹ If you're selected for a slot or claimed a YCH, I will contact you via email to confirm the quoted price and ask/address additional questions.
â—‹ You have 48 hours to reply, otherwise your order will be voided.
â—‹ All confirmed orders are added to my Public Queue and their status will be updated regularly.
â—‹ Once the order is confirmed, an invoice will be sent to the provided email. Unless previously agreed otherwise, it must be paid within 48 hours.
â—‹ Failing to pay within the agreed time frame will result in the order being voided, and another applicant will be picked. Auction winners will additionally get blacklisted.
â—‹ See section E. for more info on payment.
• 3. Draft approval phase
â—‹ Work on the commission's draft will begin after the full payment is received, unless previously agreed otherwise.
At my discretion, large projects may be started at partial payment, or thumbnail exploration may be done before payment.â—‹ For illustrations and commissions that require pose/layout exploration, the client will receive thumbnails (quick rough doodles) to choose from.
â—‹ For simpler commissions or orders with a clear direction, the client will directly receive a rough draft or more to choose from.
â—‹ The client is encouraged to give honest feedback, as large edits to the pose won't be available for free past this phase. Let's work together to make it what you want!
â—‹ Please note that rejected drafts at this stage may be reused for other artwork.
â—‹ Once the draft is approved, the order will be worked on according to the queue.
• 4. Work In Progress [WIP] phase
â—‹ Clients will receive WIPs of their commission regularly, depending on the amount of progress or necessity of feedback.
â—‹ Basic WIP stages for commissions are: thumbnail > (rough) draft > (sketch) lines > (flat) colors > rendering > final approval.
â—‹ Some commission types don't include WIPs past the approval phase, others rely heavily on communication and feedback.
â—‹ WIPs will be sent in low resolution, cropped and/or with invasive watermarks.â—‹ Clients are encouraged to give feedback at each stage, as it's their responsibility to notify me of the needed adjustments at the corresponding stage.
â—‹ Clients will be able to ask for a few small edits to the sketch lines before they are finalized.
â—‹ The only edits available past the sketch lines are those that don't compromise the rest of the piece ("fixes").
â—‹ Additional large edits or lots of small edits will be considered case-by-case and may be subjected to fees at my discretion (D.2.).
â—‹ Edits required by my own mistakes will always be free of charge.
â—‹ Giving me artistic freedom means forfeiting edits on the completed artwork for a faster turnaround, but I may still sneak in quick fixes.â—‹ In the event of no response to WIP updates, a reminder will be sent after 72 hours, and the commission will be put on pause.
â—‹ Without any response for over a week, at my discretion I may continue working on it without feedback to clear my queue or offer a refund.
â—‹ If you're unable to give feedback within that timeframe, please let me know beforehand or with a quick message. I will still issue a partial refund after 2 weeks max.
• 5. Turnaround time
â—‹ My Public Queue is updated regularly, so please refer to it before asking for updates on your order.
â—‹ My turnaround time for commissions is usually much quicker, but please allow at least 4-8 weeks from the day of payment for it to be completed.
â—‹ Bigger commissions may require a longer time to be completed, but details will be directly discussed with the client.
â—‹ If your commission has not been completed after the agreed time frame and no updates have been given for at least 4 weeks, feel free to contact me to ask about its progress or for a full refund.â—‹ Commissions, YCHs and any paid work share the same priority in my queue, and the order in which they're worked on is flexible.
â—‹ In the event of any substantial delay, I'll promptly communicate it to the clients, as well as marking it in my Schedule and mention it in my socials if necessary.
â—‹ As per section A.3., I do not work under defined deadlines. I will try to meet any ideal deadline if the client's order is placed within a reasonable time frame, but I will never take rush orders and I will not be responsible in case of failure to meet it.â—‹ Important: not all time dedicated to art is part of work days, meaning that personal art and projects will be worked on in-between paid work.
Clients are expected to respect this, as it is necessary to avoid burnout and I will do my best to remain on schedule regardless.
• 6. Delivery
Once the artwork is finished and you give the final okay, you will receive the following files through email:

â—‹ Make sure to mention any format you need when ordering, so I can make sure the commission fits potential requirements.
â—‹ Clients can freely request versions (flat version, transparent/separate version of a subject, etc) or decline existing ones.
D. Price Variations
As stated, the prices indicated on my Price List are just a baseline for private commissions and will change depending on the complexity of the subject.
Each quote will be discussed privately with the client and will go on a case-by-case basis.

â—‹ Any and all price variations depend on complexity and are cumulative, but only if relevant to the pose and visible (ie. if wings are mostly hidden, they won't incur in a fee).
â—‹ You may ask for anything complex to be simplified to avoid the upcharge. The artist has a final say on it.
â—‹ Designs will be simplified by default for commission types of simpler styles (Doodle, Mini, Chibi, Rough Sketch). Fee may still partially apply.
â—‹ Prosthetics, orthotics and mobility aids will not be upcharged by themselves, but any complex design (detailed decorations, extra parts, etc) for them could still lead to a complexity fee.â—‹ For alternate versions, upcharge depends on the level of finish and the number/extent of necessary edits to the artwork per version requested.
â—‹ Particularly simple versions that don't require extensive editing may be free.
○ The indicative rate for extra versions is 20€/h, but it will be discussed privately as it's on a case-by-case basis.
â—‹ Important: extra versions must be requested during draft phase, otherwise they will fall under revision fees.â—‹ Temporary exclusivity (posting the artwork after a certain date) and anonymity (not having your username displayed) are completely free of charge.
â—‹ Exclusivity can only be requested beforehand, as I will not delete public work at a client's request.
â—‹ As a free alternative, recoloring the character(s) for the public version is an option anonymize you (ie. your white cat becomes a gray cat). However, lines won't be changed and you won't have any rights over that artwork version.
• 2. Revision fees

â—‹ When asking more than the available revisions at the correct phases (listed above), the client aknowledges they may be required to pay revision fees for further editing.
○ The indicative fee rate for revision edits is 20€/h, but it will be discussed privately with the client on a case-by-case basis.
â—‹ Price might be higher for late-stage revisions, especially if time-consuming.
â—‹ Revision fees will be billed separately and must be paid in full before the files are delivered.
â—‹ Editing completed work can be up for discussion within the year since completion. Fees may apply depending on request's complexity. Past that time frame, it's on case-by-case basis, as I may not have access to the complete work files anymore.
E. Payment
○ Payment is always in € (EURO).
â—‹ The standard payment method is Paypal invoices. (SumUp/Revolut payment links, bank transfers, and other payment options are being considered at the moment.)
â—‹ No form of cryptocurrency is accepted.â—‹ Payment is in full upfront.
â—‹ Work on the draft won't be started until payment is received in full.
â—‹ Larger projects may be granted payment plans and custom agreements.
○ Split payments between multiple clients can be arranged for projects above €100 total and YCHs.

• Pay What You Want: I will work on it depending on how much you pay. Important: complexity of character will impact overall rendering.
• Experimental, but client can still give a direction/preference for the style (binary style, regular style, cell or soft shading, etc), mood (colors, emotions, amount of edginess, etc) and part of the song to focus on.○ No WIP will be provided past the draft phase, but mistakes will be fixed.

Glossary and ClarificationsType: the category name of the commission type (the ones listed at the top of this page)
Tier: tiers within commission types. Usually how much of the character is drawn (Portrait, Halfbody, Fullbody) or at what rendering level (Plain, Colored, Rendered)
Style: the style itself, which can be its own type (Rough Sketch, Clean Sketch, Chibi, Mini, Doodle) or vary in others (a Sketch Page can have multiple styles, a Scene can be of any style, etc)Default background: colors, gradients, shapes, textures, transparency. Usually abstract or with very few simplified elements.
Simple background: background with few/simple elements, hinting at a larger environment.
Detailed background: more complex environment, with all/most of the elements appropriately detailed.â—‹ Sketches are the default for my art, as I no longer offer commissions with perfectly clean lines. If you want clean lines, you have to ask for them as an off-menu option.
â—‹ The definitions of portrait (headshot to bust), halfbody (bust to waist-up) and fullbody are intentionally loose, so that they may be flexible and fit different creatures and poses.
â—‹ Rendering is intended as shading, highlights and details added on top of flat colors.
â—‹ Background complexity is on a spectrum and more of a guideline, as it always depends on the subject (ie. a landscape is simpler than a decorated room).
